Elgar Parishad Case: Supreme Court Delays Bail Hearing for Activist Surendra Gadling Until September

The judicial journey for activist-lawyer Surendra Gadling, entangled in the high-profile Elgar Parishad case, has been extended once again. In a recent development, the Supreme Court of India decided to defer the hearing of his bail plea, pushing the next crucial date to September 17, 2024. This decision, rendered by a bench comprising Justices Aniruddha Bose and Augustine George Masih, comes as a significant pause in the ongoing legal battle that has kept Gadling incarcerated since 2018.

The deferral was primarily prompted by a request from senior advocate Anand Grover, representing Mr.

Gadling. Mr. Grover sought additional time to file a rejoinder, a formal reply, to the detailed counter-affidavit submitted by the National Investigation Agency (NIA). The NIA, the principal investigative body in this complex case, had already presented its arguments against Gadling's bail. This procedural step underscores the meticulous and often time-consuming nature of high-stakes legal proceedings, particularly those involving national security legislation.

Surendra Gadling, a human rights lawyer and activist, was arrested on June 6, 2018, as part of a widespread crackdown related to the Elgar Parishad event.

He faces grave charges under the Unlawful Activities (Prevention) Act (UAPA), a stringent anti-terror law. The accusations against him, and others in the case, revolve around alleged Maoist links and their supposed role in inciting the caste violence that erupted near the Bhima Koregaon war memorial on January 1, 2018.

The state's narrative posits that the Elgar Parishad conclave, held on December 31, 2017, in Pune, served as a platform for inflammatory speeches that contributed to the subsequent unrest.

Gadling's current appeal before the apex court challenges an earlier ruling by the Bombay High Court. In October 2023, the High Court had denied him bail, leading him to seek redress at the highest judicial forum.
