The court said forcing diners to pay a service charge is illegal and that restaurants must honor the voluntary nature of such fees.
Chaayos (Sunshine Teahouse Pvt. Ltd.) was the first to feel the heat. The CCPA slapped the chain with a Rs 50,000 penalty and ordered it to refund the illegitimately collected charges. Moreover, Chaayos has been told to re‑engineer its billing software so that service fees can’t sneak in on their own.
Barbeque Nation and a host of other eateries – including Café Blue Bottle (Patna), China Gate Restaurant, Fiesta Barbeque Nation, FOO Ahmedabad, L’Opera French Bakery, and Zorro – have also received final orders. In most cases, the authority is demanding refunds and system changes, while investigations into the rest are still ongoing.
For ordinary diners, the message is simple: if a bill suddenly shows a service charge, you have the right to question it. The CCPA urges anyone who spots such an addition to call the toll‑free helpline 1915 or lodge a complaint via the NCH portal.
