Calcutta High Court Adjourns Abhishek Banerjee's Plea Against Eight FIRs, Denies Immediate Protection

It was a day of mixed outcomes, or perhaps, a temporary setback, for Trinamool Congress (TMC) MP Abhishek Banerjee at the Calcutta High Court. His plea, aiming to shield him from potential police action across a whopping eight different First Information Reports (FIRs), faced a crucial hearing on July 23, 2026. But alas, no immediate respite was granted; the court decided to push the matter to July 30, leaving Banerjee in a somewhat precarious position for the time being.

Mr. Banerjee, who also holds the influential post of TMC National General Secretary, had approached Justice Saugata Bhattacharyya's bench, essentially asking for a protective umbrella against any 'coercive police action' stemming from these numerous cases. His legal strategy was spearheaded by none other than Senior Advocate Kapil Sibal, a veteran known for his formidable courtroom presence. Sibal was really pushing for the court to grant Banerjee similar interim protection, much like what was once extended to Suvendu Adhikari, the former Leader of Opposition.

However, Justice Bhattacharyya, after carefully considering the arguments, wasn't swayed to grant that immediate, much-desired interim relief. The judge made it quite clear that the previous order favoring Suvendu Adhikari couldn't simply be treated as a cookie-cutter precedent for Mr. Banerjee's current petition. Each case, it seems, must stand on its own distinct merits, and the circumstances, in this instance, were deemed sufficiently different. Still, as a safeguard, the court did direct Banerjee's legal team to promptly inform the bench if any action were to be taken against him under those eight FIRs before the next scheduled hearing. That's a small but significant detail, isn't it?

The complaints themselves, which form the basis of these eight FIRs, are scattered across various police stations in West Bengal. We're talking places like Bhabanipur in Kolkata, Siliguri, Kalitala, and Bishnupur in the South 24 Parganas district – quite a geographical spread, indicating the breadth of the allegations. Sibal’s argument had hinged heavily on the Adhikari precedent, suggesting that if similar protection was afforded to another prominent political figure, it should naturally apply here too. But the court, maintaining its judicial discretion, chose to differentiate the scenarios.

The decision to adjourn the hearing until July 30, 2026, largely came at the behest of the State government. Represented by Additional Solicitor General S.V. Raju, the state requested the postponement, indicating that the Solicitor General himself would be arguing on their behalf in the upcoming session. This suggests the state is preparing for a robust defense against Banerjee's petition, making the next hearing all the more crucial and, frankly, quite anticipated.
