Allahabad High Court Upholds Magistrate's Order in Sikh Remarks Case Against Rahul Gandhi

In a significant legal development, the Allahabad High Court has dismissed a plea filed by prominent Congress leader Rahul Gandhi, challenging a lower court's order that directed a fresh hearing by a magistrate in a case concerning alleged derogatory remarks against the Sikh community. This ruling marks a notable setback for Gandhi, effectively upholding the Sultanpur court's decision to re-examine the matter.

The controversy stems from comments reportedly made by Rahul Gandhi during a press conference held in Delhi in 2016.

These remarks, which allegedly targeted the Sikh community, drew strong condemnation and led to legal action. Advocate Sardar RP Singh subsequently filed a complaint against Gandhi in an MP-MLA court in Sultanpur, initiating the judicial process.

Initially, the lower court had acquitted Rahul Gandhi in the case.

However, this acquittal was not the final word. Advocate Singh, the complainant, filed a revision application against the acquittal. Responding to this application, the lower court took a crucial step: it remanded the matter back to a magistrate, instructing a fresh hearing of the case. This decision essentially reopened the legal proceedings, requiring a thorough re-evaluation of the evidence and arguments.

Rahul Gandhi's legal team then approached the Allahabad High Court, seeking to overturn the lower court's order of remand.

His counsel vehemently argued that the trial court's decision to send the case back to the magistrate was both illegal and passed without proper jurisdiction. They contended that such an order was not within the purview of the lower court's powers in this specific context and sought its quashing.

After carefully considering the arguments presented by both sides, Justice Rajesh Singh Chauhan, presiding over the case, delivered the verdict.

The High Court found no illegality or procedural impropriety in the lower court's order to remand the matter for a fresh hearing. Consequently, the court concluded that Rahul Gandhi's plea lacked merit and proceeded to dismiss it.

This dismissal means that the case against Rahul Gandhi, regarding the alleged derogatory remarks made in 2016, will now proceed for a fresh hearing before a magistrate in Sultanpur.
