Federal Judge Delivers Major Blow: Halts Trump's Nationwide Speedy Deportation Push

In a significant legal setback for the Trump administration, a federal judge has issued a preliminary injunction, effectively blocking the White House's controversial plan to dramatically expand speedy deportations of undocumented immigrants across the nation. The ruling, handed down by U.S. District Judge Dolly Gee in Los Angeles, states that the policy likely violates the due process rights of individuals and goes against existing federal laws.

The administration's directive aimed to broaden the application of 'expedited removal,' a process that allows immigration officers to deport individuals without a hearing before an immigration judge.

Previously, this streamlined deportation process was primarily applied to immigrants apprehended near the U.S. border who had been in the country for less than 14 days. The new policy, unveiled in July, sought to extend this authority to anyone unable to prove they had been continuously present in the U.S.

for at least two years, regardless of their location within the country.

This sweeping change would have subjected potentially hundreds of thousands, if not millions, of immigrants to immediate removal, circumventing the standard legal process. Critics argued that such an expansion would ensnare long-term residents, asylum seekers, and even some U.S.

citizens who might struggle to produce immediate proof of their continuous residency, thereby jeopardizing their fundamental rights.

Judge Gee's decision highlighted serious concerns regarding the potential for arbitrary application and the lack of safeguards under the expanded policy. Her injunction provides a temporary halt, allowing time for the legal challenges brought by the American Civil Liberties Union (ACLU) and other immigrant rights organizations to proceed.

The judge underscored that the government failed to adequately demonstrate that the policy adheres to established legal precedents and constitutional protections.

Immigration advocacy groups hailed the ruling as a critical victory for due process and the rule of law. Omar Jadwat, director of the ACLU's Immigrants' Rights Project, commented on the importance of the decision, stating that it ensures people are not 'snatched from their homes and communities without a moment to speak to a lawyer, or a judge, or even their families.' The groups have consistently argued that the policy represented an unprecedented power grab designed to bypass the court system.

Conversely, the Department of Justice expressed strong disapproval of the judge's order, contending that it undermines their efforts to enforce immigration laws and secure the nation's borders.

They have indicated plans to appeal the ruling, emphasizing the administration's stance that such measures are necessary to address what they describe as a crisis at the border and within the interior of the country.
