Suspect charged in fight at Philly subway station that led to man being killed by oncoming train

A Philadelphia man believed to be homeless was that ended with another man falling onto the tracks and being fatally struck by an oncoming train. The Philadelphia District Attorney’s Office announced Friday that who has no fixed address, is currently in custody and charged with involuntary manslaughter, reports ABC affiliate WPVI.
The incident, which resulted in the death of a 38 year old man who has yet to be identified, occurred around 4:30 p.m. Thursday and was captured on video. In the cellphone footage, the two men are seen arguing on the platform of the Market Frankford line at 34th and Market Street. According to NBC Philadelphia, one man can be heard demanding something from the other, while police say the victim held onto Wearing, “scolding him and making threatening gestures.” After being let go, Wearing throws two punches at the man, causing him to fall onto the tracks.
Just seconds later, he’s hit by a SEPTA train pulling into the station. Wearing’s criminal history spans across multiple Pennsylvania counties, said the District Attorney’s office. Prior to this latest incident, he already had a warrant out for his arrest for a strangulation case in Delaware County.
“We have a history with the offender in this case. We certainly know him from other contacts, a long criminal history. The victim in this case, we really had no prior contacts with. However, he had also a long criminal history,” said SEPTA’s Chief of Police Chuck Lawson. “We had transit police at the station at the time.
They had just left the platform. That’s how quick this occurred,” Lawson added. The 34th Street Station and the surrounding area near Drexel’s campus were closed Thursday for several hours following the incident. Police reportedly took Wearing into custody at the 40th Street Station, and are still investigating the circumstances which led to the altercation..
