BC Court of Appeal Upholds Ostrich Cull: Farmers Face Finality Amid Welfare Crisis

A critical legal battle over the fate of hundreds of ostriches in British Columbia has reached a somber turning point. The BC Court of Appeal has decisively ruled to uphold an order allowing the culling of approximately 400 ostriches from a Fraser Valley farm. This latest judicial decision marks a significant setback for the farmers, who have tirelessly fought to prevent the mass culling of their flock.

The saga began with an order from the Ministry of Agriculture and Food, driven by grave concerns over both public health and animal welfare.

The ostriches were found to be living in conditions described as severely inadequate, including overcrowding, unsanitary environments, and a notable lack of essential veterinary care. Furthermore, a pressing concern was the potential spread of psittacosis (also known as ornithosis), a bacterial infection that can be transmitted from birds to humans, posing a direct public health risk.

Farmers, however, fiercely contested these allegations, arguing that their birds were healthy and that a mass culling was an unnecessary and economically devastating measure.

Their legal challenge first led them to the BC Supreme Court, where the initial cull order was affirmed. Undeterred, they pursued an appeal to the BC Court of Appeal, seeking a stay of the order and a re-evaluation of the case.

In a ruling issued on June 13, 2024, the BC Court of Appeal sided with the lower court and the Ministry, denying the farmers' request for a stay.
